Terms of Service

1. Agreement to Terms

By accessing or using the Xfer mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Xfer is a platform that connects football players, coaches, and clubs. The Service allows users to:

  • Create and manage professional profiles
  • Search and discover players, coaches, and clubs
  • Communicate with other users through direct messaging
  • Showcase skills, achievements, and career statistics
  • Explore career opportunities and talent

3. User Accounts

Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Eligibility

You must be at least 13 years old to use this Service. Users under 18 should use the Service with parental guidance.

4. User Content

Your Content

You retain ownership of content you submit to the Service. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the Service.

Content Standards

You agree not to post content that:

  • Is false, misleading, or fraudulent
  • Violates any third-party rights (copyright, trademark, privacy)
  • Contains hate speech, harassment, or discrimination
  • Contains explicit, violent, or inappropriate material
  • Promotes illegal activities
  • Contains spam or unsolicited advertising

5. Prohibited Uses

You may not use the Service to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service
  • Use automated systems (bots, scrapers) without permission
  • Collect or harvest user data without consent
  • Engage in any fraudulent or deceptive practices

6. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Xfer and are protected by international copyright, trademark, and other intellectual property laws.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your personal information.

8. Communications

By using the Service, you consent to receive communications from us electronically, including emails and in-app notifications. You agree that all agreements, notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time by visiting our account deletion page.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • User-generated content is accurate, reliable, or appropriate

11. Limitation of Liability

IN NO EVENT SHALL XFER, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Xfer from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Croatia, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from these Terms or the Service shall first be resolved through good faith negotiations. If a resolution cannot be reached within 30 days, the dispute may be submitted to binding arbitration or mediation.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
